Roomz MY - Terms of Use

1. WHO WE ARE

Roomz.asia is owned and managed by EasyRoomz Sdn Bhd, a company incorporated in Malaysia and having its registered address at No. 0203A, PV128, Jalan Genting Klang, Setapak, 53300 Kuala Lumpur, W.P. Kuala Lumpur, Malaysia. (“Roomz.asia”, “we”, “us” or “our”) pertaining to the use of property renting services.

We appreciate and value your access to the Roomz.asia and in order to secure and safeguard your interest and ensure that you enjoy property renting services provided herewith peacefully, we have set out terms and conditions to facilitate and govern your access and use of this platform.

2. ACCEPTANCE

The terms of use set forth herein (“Terms of Use”) govern your access and use of Roomz.asia and the use of any services, information and functions made available by us (“Roomz.asia Services”) at the designated digital platforms which you have access to including but not limited to https://roomz.asia website or mobile application software through the “Android” or “iOS” mobile application or whatsoever digital platform available (“this e-Platform”). Your use and/ or continued usage of this e-Platform and Roomz.asia Services constitutes your full agreement to the Terms of Use, our Privacy Policy and all other policies, which shall form a legally binding and enforceable contract between you and our company.

Notwithstanding the above, we reserve the right (i) to refuse or bar your access to this e-Platform or to allow you to register an Account for any reason; and (ii) to refuse to authorize or grant you license to use and access to this e-Platform. If for any reason you do not agree with or cannot abide by the Terms of Use, our Privacy Policy and all other policies, you may exit this e-Platform immediately and delete all or any accounts that you have registered with this e-Platform.

If you are a minor under the age of 18 or the legal age for giving consent hereunder pursuant to the applicable laws in your country, you must obtain permission or consent from your parent(s) or legal guardian(s) to use and access to this e-Platform. If you are the parent(s) or legal guardian(s) of a minor who is creating an account, you must accept and comply with the Terms of Use on the minor's behalf and you will be responsible for the minor’s actions including any charges associated with the minor’s use of this e-Platform and/or Roomz.asia Services made on this e-Platform. If you do not have permission or consent from your parent(s) or legal guardian(s), you must stop using/accessing this e-Platform and/or Roomz.asia Services.

3. VARIATIONS AND CHANGES

We reserve the rights to update the Terms of Use including but not limited to amend, add or omit the Terms of Use from time to time and you are advised to read and review the Terms of Use regularly and to adhere with the Terms of Use to ensure that you are aware of your rights and obligations as the User of this e-Platform. Any changes and/or amendments will be effective when posted on this e-Platform with no other notices provided and you are deemed to be aware of and bound by any changes to the Terms of Use upon our publication of the same on this e-Platform.

Any subsequent URL which may replace this e-Platform and your access and use or continued usage of this e-Platform and Roomz.asia Services shall be deemed as an acceptance of the Terms of Use, Privacy Policy, Additional Policies and all other terms required, which shall form a legally binding and enforceable contract between you and this e-Platform.

4. DEFINITION

“Account” means a registered account which you create and register with us if you wish to access and utilise the full facilities and features of this e-Platform and Roomz.asia Services, whether as an Owner or User;
“Additional Policies” means any and all other operating rules, policies, and / or guidelines in addition to the Terms of Use, that may govern the use of this e-Platform and which is made known to you from time to time;
“Content” means information, data material or publication published, created, uploaded, transmitted, or otherwise made available on this e-Platform included but not limited to, the following categories:
  • (i) Owner’s Content – any content relating to properties listing, including but not limited to property description, rental terms, pricing, photographs, floor plans, location details, availability status, and other information directly connected with the marketing, advertising, or offering of a property;

  • (ii) User’s Content – any other content provided by User to this e-Platform, including but not limited to messages, reviews, inquiries, feedback, profile information, text, images, applications, archived messages, data, and other materials not falling within the Property Content.
“e-Platform” means:
  • (i) the websites bearing the domain “https://roomz.asia” and any other related microsites and/or mobile or web applications owned and operated by Roomz.asia which may or may not be of similar names; and

  • (ii) any related or ancillary facilities or functions such as e-mails, SMS, newsletters, notifications or other communication or content.
“e-Tenancy” means the tenancy agreement, whether in electronic or digital form, to be entered into directly between an Owner and a Tenant upon the conclusion of a Rental Engagement through this e-Platform. For avoidance of doubt, Roomz.asia is not a party to any e-Tenancy and assume no responsibility or liability, for the validity, enforceability, or performance of such agreement.
“Owner” and “Owners”, as applicable means any individual, company, or other legal entity that publishes, posts, or advertises a property listing via this e-Platform and/or Roomz.asia Services, whether on its own behalf or on behalf of a third party, and includes their authorised representatives, agents, or assigns.
“Password” means the password which you create, register, provide and use in order to create and use an Account and you are solely responsible to safeguard your Password during the usage of this e-Platform;
“Privacy Policy” means a statement or legal document (in privacy law) that discloses some or the methods Roomz.asia gathers, uses, discloses, and manages a User’s data.
“Property” means any premises, space, or accommodation listed on this e-Platform by an Owner, including but not limited to single rooms, full residential units, short-term homestays, car parks, and event spaces, whether offered for rent, lease, or temporary use.
“Roomz.asia Services” means the services and facilities provided by Roomz.asia through this e-Platform, including but not limited to the following categories:

  • (i) Owner Services – services enabling and facilitating Owners to manage their property listing, including but not limited to:
    • publishing, advertising and updating Property listings;
    • creating, maintaining, and updating Owner profiles;
    • managing inquiries, communications and responses from User and/or potential tenant;
    • facilitating contact, negotiation, and contracting with User; and
    • accessing tools, features or functionalities provided to support Property marketing and rental management.

  • (ii) User Services – services enabling and facilitating User to search, evaluate and connect with Owners, including but not limited to:
    • searching, filtering, and browsing listings, across this e-Platform;
    • making inquiries, sending messages, and reviewing Owner information or listings; and
    • facilitating contact, negotiation, and contracting with Owners; and
    • accessing tools, features, or functionalities provided to support Property search and rental decision-making.
And any other ancillary, incidental, or related services, features or functionalities as Roomz.asia may introduce, modify, or discontinue from time to time;
“Rental Engagement” means any and all interaction, communications, negotiations, and arrangements carried out between an Owner and a User through this e-Platform, including but not limited to property inquiries, exchange of information, discussion on rental terms and the conclusion or non-conclusion of any rental arrangement.
“Terms of Use” means, refer to and include the terms and conditions set out herein and the versions of the same which may be modified from time to time;
“User”, “Users”, "you" and "your", as applicable means a person who accesses, uses, and/or participates in this e-Platform in any manner, whether as an Owner or User;

5. PRIVACY POLICY

It is a pre-requisite condition that you must consent to the processing of your personal data as described in the Privacy Policy set out at Roomz.asia (“Privacy Policy”) in order for your access, use and exploitation of this e-Platform and Roomz.asia Services. Once again, by accessing this e-Platform and/or using Roomz.asia Services, you agree to be bound by the Privacy Policy and any amendments to the foregoing issued by us from time to time. If you do not agree to the Privacy Policy, please do not access and/or use this e-Platform and/or Roomz.asia Services.

6. USAGE OF THIS e-PLATFORM AND/OR ROOMZ.ASIA SERVICES

a) In consideration of your acceptance of the Terms of Use herein and your agreement to be bound by the Terms of Use, we grant you a revocable and non-transferable license to use this e-Platform and/or Roomz.asia Services which is effective until revoked, subject to these Terms of Use, for the purpose of accessing this e-Platform. Any breach of these Terms of Use shall result in the immediate revocation of the license granted herein without notice to you.

b) By accepting the Terms of Use of this e-Platform, you agree and accept not to: -

  • Upload, create, transmit, or otherwise make available any Content that violated the laws of Malaysia or infringes upon public and private rights including but not limited to content that is defamatory, violent or cruel, indecent, obscene or pornography, sexually explicit, degrading, or suggestive of prostitution, offensive, abusive, or hateful in nature; or otherwise false, misleading, or unlawful. This prohibition applies irrespective of intent, including whether such content is intended to annoy, abuse, threaten, or harass any person;
  • use the e-Platform and/or Roomz.asia Services for the benefit of any third party or any manner not permitted by the licenses granted herein;
  • use the e-Platform and/or Roomz.asia Services or upload Content to impersonate any person or entity;
  • use the e-Platform and/or Roomz.asia Services or upload Content in a manner that is fraudulent, unconscionable, false, misleading or deceptive;
  • circumvent or attempt to circumvent the Roomz.asia by entering into, negotiating, or concluding any Rental Engagement, lease, sale, or other property-related transaction in respect of the Property listed in this e-Platform outside Roomz.asia, whether directly or indirectly. This includes, without limitation, any effort to avoid payment of fees, commissions, or charges applicable to the use of Roomz.asia Services, or to otherwise deprive Roomz.asia of the benefit of facilitating such transactions.
  • open and/or operate multiple Accounts in connection with any conduct that violates these Terms of Use;
  • attempt to decompile, reverse engineer, disassemble or hack this e-Platform and/or Roomz.asia Services (or any portion thereof), or to defeat or overcome any encryption technology or security measures implemented by Roomz.asia with respect to Roomz.asia Services and/or data transmitted, processed or stored by Roomz.asia;
  • harvest or collect any information about or regarding other Users and/or Account holders, including but not limited to any personal data or information;
  • use Roomz.asia Services to collect or store personal data about other Users and/or Account holders in connection with the prohibited conduct and activities set forth above;
  • infringe the rights of Roomz.asia, including any intellectual property rights and any passing off of the same thereof;

c) You understand that all Content, whether publicly posted or privately transmitted, is the sole responsibility of the person from whom such content originated. This means that you, and not Roomz.asia, are entirely responsible for all Content that you upload, post, email, transmit or otherwise make available through this e-Platform or any microsites thereof. You understand that by using this e-Platform, you may be exposed to Content that you may consider to be offensive, indecent or objectionable. To the maximum extent permitted by applicable law, under no circumstances will Roomz.asia be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of, or reliance on, any Content posted, emailed, transmitted or otherwise made available on this e-Platform or any microsites thereof.

d) You acknowledge that Roomz.asia and its designees or authorized persons shall have the right (but not the obligation) in their sole discretion to pre-screen, refuse, delete, stop, suspend, remove or move any Content, including without limitation any Content or information posted by you, that is available on this e-Platform without any liability to you. Without limiting the foregoing, Roomz.asia and its designees or authorized persons shall have the absolute and discretionary right to remove any Content (i) that violates these Terms of Use; (ii) if we receive a complaint from another User; (iii) if we receive a notice or allegation of intellectual property infringement or other legal instruction or request for removal; or (iv) if such Content is violated the laws of Malaysia or otherwise objectionable. We may also block delivery of a communication (including, without limitation, status updates, postings, messages and/or chats) to or from Roomz.asia Services as part of our effort to protect Roomz.asia Services or our Users, or otherwise enforce the provisions of these Terms of Use. You agree that you must evaluate, and bear all risks associated with, the use of any Content, including, without limitation, any reliance on the accuracy, completeness, or usefulness of such Content. In this regard, you acknowledge that you have not and, to the maximum extent permitted by applicable law, may not rely on any Content created by Roomz.asia or submitted to Roomz.asia, including but not limited to information in all other parts of this e-Platform.

7. ACCOUNT SECURITY

We take security matters very seriously and we shall use our best endeavor to secure and safeguard the security of this e-Platform and the activities to be conducted on this e-Platform. Nevertheless, it is your duty and responsibility to ensure the following:

  • maintaining adequate security and control over your Account sign-in details, including but not limited to any username, passwords, personal identification numbers, or any other codes associated with your Account;
  • keeping your contact details up to date so that you can receive any notices or alerts we may send to you by way of Electronic Communications;
  • maintaining security and control over the email mailbox, phone number and devices associated with your Account.

Failure to take the above measures, and any other security measures available to you, may result in or expose you to unauthorized access to your Account.

Any loss, theft or damage to your Account attribute to you or due to your commission or omission or negligence shall be solely assumed by you alone. We shall have no liability to you for or in connection with any unauthorized access to your Account, where such unauthorized access was due to no fault at our end, and/or any failure by you to act upon any notice or alert that we send to you.

The security of your Account may be compromised, or interruption caused to it, by phishing, spoofing or other attack, computer viruses, spyware, scareware, Trojan horses, worms or other malware that may affect your computer or other equipment. We strongly recommend that you regularly use reputable virus screening and prevention software and remain alert to the fact that SMS, email services and search engines are vulnerable to spoofing and phishing attacks.

Care should be taken in reviewing messages purporting to originate from us and, should you have any uncertainty regarding the authenticity of any communication, you should log in to your Account through this e-Platform to review any transactions or required actions.

To the maximum extent permitted by applicable law, you accept and agree that you have full responsibility for all activity that occurs in or through your Account and accept all risks of any unauthorized or authorized access to your Account.

8. USER’S TERMS

By accessing to this e-Platform, the User understands, acknowledges, undertakes and agrees that: -

a) The User is a capable person and is able to bind himself in a legal agreement.

b) The User is required and must provide an active telephone number, email address, mailing address and all other particulars required under the registration process when registering for an Account with Roomz.asia. In addition, the User must undergo and complete identity verification through electronic Know Your Customer (eKYC) procedures as prescribed by Roomz.asia from time to time;

c) Roomz.asia without prior notification to the User, has the authority to take necessary actions for any alleged violation or violation of the Terms of Use and/or applicable legal regulations including but not limited to account moderation, account closure, order/ request/ subscription cancellation, Account suspension, and/or Account deletion.

d) By accepting this Terms of Use, User are required to adhere strictly to the following prohibition: -

  • any copying in whatsoever format (electronic or otherwise);
  • any commercial use of any part of this e-Platform unless express written consent is obtained from us;
  • usage of any computer program tools or device program algorithm methodology or any similar equivalent processes to access, acquire, copy or monitor any part of this e-Platform or Content;
  • reproducing or circumventing any navigational structure or presentation of this e-Platform or Content;
  • obtaining or attempt in obtaining any materials, documents, information by any means whatsoever not purposely made available through this e-Platform;
  • copy, reproduction, republishing, uploading, encoding, modifying, translating, displaying, exploiting commercially, distribution, transmitting of any portion of this Website or make any derivative works from this e-Platform to another website without express written consent from us;
  • posting or transmitting any unlawful, threatening, defamatory, obscene, scandalous, inflammatory, pornographic, profane material or any material that could constitute or encourage conduct that would be considered a criminal offense or give rise to civil liability or otherwise breach any law;

We reserve all rights unless expressly stated otherwise and we shall not be responsible if User breach any intellectual property laws or any other laws due to User’s failure to comply with any of the prohibition above.

9. OWNER’S TERMS

Subject to the agreement or terms of use separately signed by the Owner, it is agreed that the Owner understands, acknowledges, undertakes and agrees that: -
a) the Owner is a capable person or entity and is able to bind himself/herself/itself in a legal agreement.
b) subject to Clause 2, the Owner is required and must provide an active telephone number, email address, mailing address, person-in-charge contact, and particulars required under the registration process when registering for an Account with Roomz.asia. In addition, the Owner must undergo and complete identity verification through electronic Know Your Customer (eKYC) procedures as prescribed by Roomz.asia from time to time;
c) by setting up an Account with Roomz.asia, the Owner has consented Roomz.asia to use the Owner’s personal data or information if required; including, but not limited to, when Roomz.asia is conducting investigation and verification of the Owner’s identity and any other Roomz.asia Services;
d) for the purpose of promoting the Property listed by Owner, Roomz.asia may post such Property on third-party websites (such as portal sites and price comparison sites) and other websites (domestic or foreign) operated by Roomz.asia;
e) the Owner shall be solely responsible for paying (i) all taxes, quit rent, assessment, levies, or other charges which the Owner is required by law to pay in respect of the Property, and (ii) any taxes, duties, or governmental charges that may arise in connection with the rental or licensing of the Property through this e-Platform. Roomz.asia does not provide any legal, accounting, or tax advice in this regard. As tax law and regulations may change from time to time, Owners are advised to seek independent professional advice if in doubt;
f) Roomz.asia shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses resulting from the use of or inability to use the Roomz.asia Service;
g) To the extent permitted by applicable laws, in no event shall Roomz.asia be liable for loss of profits or any special, incidental or consequential damages arising out of or in connection with this e-Platform or Roomz.asia Services or these Terms of Use. Roomz.asia is in no responsibility to indemnify and to hold any of the Owner, or Owner’s subsidiaries, affiliates, partners, officers, directors, agents, employees, and suppliers harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of the Owner’s breach of these Terms of Use or the documents it incorporates by reference, or the Owner’s violation of any law or the rights of a third party.
h) Any Content including Property listing, photos, descriptions, review, messages, or other material that you post, upload, or transmit on or through the Roomz.asia Services is not considered confidential by Roomz.asia. You hereby grant Roomz.asia a worldwide, non-exclusive, royalty-free, transferable and sub-licensable license to use, reproduce, distribute, adapt, publicly display, and otherwise make available such content on or in connection with the Roomz.asia Services, including for the purpose of operating, promoting, and improving this e-Platform. This license continues until you remove or delete your Content from the Platform, except where such Content has been shared with other User or third parties, in which case the license shall continue to apply to the extent of such prior use.
i) The Owner and Roomz.asia agree to use each party’s Confidential Information solely as necessary for performing its obligations under these Terms of Use and in accordance with any other obligations in these Terms of Use. The Owner shall agree that he shall take all reasonable steps, at least substantially equivalent to the steps he takes to protect his own proprietary information, to prevent the duplication, disclosure or use of any such Confidential Information, other than (i) by or to his employees, agents and subcontractors who must have access to such Confidential Information to perform such party’s obligations hereunder, who each shall treat such Confidential Information as provided herein, and who are each subject to obligations of confidentiality to such party that are at least as stringent as those contained herein; or (ii) as required by any law, regulation, or order of any court of proper jurisdiction over the parties and the subject matter contained in these Terms of Use, provided that, if legally permitted, the receiving party shall give the disclosing party prompt written notice and use commercially reasonable efforts to ensure that such disclosure is accorded confidential treatment.

9.1. Owner’s Obligations

a) The Owner shall properly manage and ensure that all Content related to the Property are kept up to date on this e-Platform.
b) By accepting this Terms of Use, the Owner shall not:
  • use the Platform or Roomz.asia Services for any unlawful, fraudulent, or unauthorized purpose (including but not limited to intellectual property rights);
  • post, upload, or transmit any inappropriate, false, misleading, offensive, or defamatory Content in Property listings, communications, or otherwise through this e-Platform;
  • list or advertise any Property which the Owner does not have the legal right, authority, or consent to lease, license, or otherwise make available to the User;
  • offer, advertise, or conclude any Rental Engagement that is in violation of applicable laws, regulations, or our housing policies;
  • use misleading information, keywords, or descriptions in listings or communications that do not accurately reflect the Property or rental terms;
  • assign or otherwise transfer the Terms of Use, or any of rights or obligations hereunder, to any third party without prior written consent of Roomz.asia, such consent to be given or withheld in Roomz.asia’s sole discretion.

10. E-TENANCY

a) The Owner and User acknowledge and agree that Roomz.asia is not a party to any e-Tenancy and assumes no responsibility or liability whatsoever for the validity, enforceability, legality, or performance of such agreement.
b) The Owner and User enter into any e-Tenancy solely at their own discretion, judgment, and free consent. They are exclusively responsible for negotiating, agreeing to, and executing the terms of any e-Tenancy, including but not limited to rental amount, duration, deposit, utilities, maintenance, and any other obligations or conditions.
c) Roomz.asia does not verify, endorse, or guarantee the accuracy, completeness, or legality of any terms agreed upon in an e-Tenancy, nor does it mediate or resolve dispute arising therefrom.
d) Where Roomz.asia provides optional tools or features (including electronic templates, e-signature function, or digital storage) to assist in the execution of an e-Tenancy, such tools are provided on an “as is” basis without warranty of any kind. Use of such tools shall not create any liability or obligation on the part of Roomz.asia in respect of the e-Tenancy.

11. RETURN AND REFUND POLICY

a) Any deposit or monies paid through this e-Platform in connection with any deposit, rental engagement or e-Tenancy are non-refundable through Roomz.asia. All such deposits or monies shall be governed strictly by the terms and conditions of the respective e-Tenancy. Roomz.asia shall have no obligation to process, facilitate, or guarantee any refund.
b) The responsibility to refund any deposit, rental, or other payment rests solely with the Owner, subject to the terms of the application e-Tenancy. Roomz.asia shall not be liable for any non-refund, delay, or disputing relating to such payments.
c) Any termination of an e-Tenancy, including but not limited to the consequences for deposit or advance rental, shall be dealt with directly between the Owner and the User in accordance with the terms of the respective e-Tenancy. Roomz.asia shall not mediate, intervene, or be responsible for any such matters.
d) User acknowledge that Roomz.asia does not guarantee the recovery of any deposit, rental, or monies paid, whether in cases of early termination, breach, or otherwise. Users are encouraged to exercise due care and judgment before entering into an e-Tenancy.
e) Any service fees or charges paid to Roomz.asia for the use of this e-Platform are strictly non-refundable, regardless of whether an e-Tenancy is successfully concluded, terminated, or disputed.
f) Any disputes regarding refunds, returns, or deductions from deposits shall be resolved exclusively between the Owner and User, without involving Roomz.asia.

12. CUSTOMER SERVICE CENTRE

a) The Customer Service Center is a support service provided by Roomz.asia to assist Users in addressing issues encountered while using this e-Platform. Users may contact the Customer Service Center by sending an email to [email protected]
b) When submitting a request, Users and/or Owners are required to provide sufficient and accurate supporting information, which may include: Booking ID, User’s email address, details of issue, relevant screenshots or recordings, proof of payment, and/or any other technical details that may reasonably be required by Roomz.asia to facilitate assistance.
c) The Customer Service Center will act as a facilitator by providing reasonable guidance and recommendations to both Users and Owners. Any resolution of issues related to booking, tenancy arrangements, or deposits shall be based on mutual agreement between the User and the Owner, subject always to the terms of the respective e-Tenancy agreement.
d) If no mutual agreement is reached between the User and the Owner, Roomz.asia may, at its sole discretion, provide further assistance by reviewing the matter and advising both parties. However, Roomz.asia shall not be obliged to resolve the dispute on behalf of either party.
e) The User understands and agrees that the Customer Service Center may assist with the following matters:
  • Difficulties in creating or accessing an account on this e-Platform;
  • Errors or disruptions in the booking or payment process through this e-Platform;
  • Failure to receive confirmation of successful booking or payment;
  • Reporting of technical errors, failures, or interruptions on this e-Platform;
  • Reporting suspected abuse or misuse of Content uploaded by Owners;
  • Reporting suspected fraudulent activities by other Users or Owners, with supporting evidence. In such cases, Roomz.asia may verify the authenticity of the report, but the resolution of tenancy-related disputes, deposits or refunds shall remain the responsibility of the relevant parties;
f) User acknowledge and agree that Roomz.asia is not a party to the tenancy transaction between Users and Owners. Accordingly, any disputes relating to tenancy terms, cancellations, deposits, refunds, or any other obligations under the e-Tenancy agreement are solely the responsibility of the User and the Owner. Roomz.asia’s role is limited to providing this e-Platform and facilitating communication between parties.

13. INTELLECTUAL PROPERTY RIGHTS

a) Copyrights to all original materials, content and arrangement of this e-Platform including but not limited to layout, visual interfaces, images, look and feel, design, sound etc, and any underlying software and computer codes (“Data”) but does not include pictures, photographs and/or artworks uploaded by Users of this e-Platform belongs to and are proprietary to us and/or our affiliates and subsidiaries, where applicable. Any name, logo, trade mark, service mark, design, copyright, domain name or other intellectual properties appearing on this e-Platform is owned by us and may not be used by you without our prior written consent.
b) Any Data on this e-Platform is provided to you for your information and personal use only and may not be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective owners.
c) Roomz.asia reserves all rights not expressly granted in and to this e-Platform and the Data. You agree not to use, copy, or distribute, any of the Data other than as expressly permitted herein, including any use, copying, or distribution of Submitted Content obtained through this e-Platform for any commercial purposes. If you download or print a copy of the Data for personal use, you must retain all copyright and other proprietary notices contained thereon. You agree not to circumvent, disable or otherwise interfere with security features of this e-Platform or features that prevent or restrict use or copying of any Data or enforce limitations on use of this e-Platform or the Data therein.

14. NO WARRANTIES, LIABILITY AND/OR INDEMNITY

a) Roomz.asia does not represent that this e-Platform or any Content or service related to this e-Platform or any links from this e-Platform whether or not to third party websites will be error-free, uninterrupted or that any errors will be corrected or that usage of any service of this e-Platform or links to third party websites will provide any specific result. We shall not be responsible or liable for any damages caused by viruses or other forms of contamination or destructive features that may affect your computer or data from your account as a result of your use of the e-Platform or links to third party websites, including but not limited to downloading any materials, texts, images or otherwise from this e-Platform or links to third party websites.
b) To the fullest extent permitted by law, we shall not be liable and you shall release, hold harmless and shall indemnify us, our affiliates, subsidiaries, service providers (including but not limited to the printing company), partners, employees, agents and servants in respect of any losses and damages of any kind, including but not limited to any direct, indirect, special, incidental, consequential and exemplary damages arising out of or in connection with the use of this e-Platform and or links to third party websites.
c) This e-Platform and all data and/or information contained therein are provided on an “as is” and “as available” basis without any warranties, claims or representations made by Roomz.asia of any kind either expressed, implied or statutory with respect to this e-Platform and/or Roomz.asia Services, including, without limitation, warranties of non-infringement of third-party rights, title, merchantability, satisfactory quality or fitness for a particular purpose. All data and/or information contained in this e-Platform and/or Roomz.asia Services are provided for informational purposes only.

15. TECHNICAL MATTERS AND LIMITATION

Please be informed that Roomz.asia Services and this e-Platform is offered to Users in limited jurisdictions. This section of the Terms of Use applies to you if you access and/or use this e-Platform. In accessing and/or using Roomz.asia for any purpose, you agree and accept that:

a) all actions, submissions, or interactions performed on this e-Platform (including but not limited to creating an Account, uploading or publishing Property listings, making inquiries, sending messages, or entering into any Rental Engagement) are executed automatically by way of the system functions of this e-Platform, based on your request, confirmation, or instruction, and cannot be reversed. In the event of any technical error or issue affecting Roomz.asia’s internal systems, you may submit a report to the Customer Service Center in accordance with Clause 14. Roomz.asia may, where possible and at its sole discretion, take steps to rectify, reverse, or otherwise amend such action;
b) Roomz.asia makes no guarantee that this e-Platform will be available without interruption; that there will be no delays, failures, errors, omissions or loss of transmitted information; or that any request, listing, inquiry, or message will be executed, accepted, recorded, or remain accessible. Roomz.asia may, at any time and in our sole discretion, refuse suspend, or remove any listing, restrict access to certain functionalities, or impose such other conditions or limitations upon your use of this e-Platform as Roomz.asia deems necessary. Roomz.asia reserves the right to take such action without prior notice.

16. ELECTRONIC COMMUNICATIONS

16.1. You agree that all communications, notices, agreements, renewals, statements, and disclosures from us are deemed to have been given to you: -
a) If communicated through any electronic media as we may select from time to time, will be deemed to be notified to you on the date of transmission, publication and/or broadcast;
b) We may from time to time designate other acceptable modes of giving notices (including but not limited to e-mail or other forms of electronic communication) and the time or event by which such notice shall be deemed given.
16.2. By using this e-Platform, you consent to receiving electronic communications from us. You agree that any notices, agreements, disclosures, or other communications that we send to you electronically will satisfy any legal communication requirements, including that those communications be in writing.

17. MODIFICATION

We reserve the rights to modify and/or update the Terms of Use from time to time by uploading the updated terms of use to this e-Platform and it shall take immediate effect.

18. APPLICABLE LAW

This Terms of Use and all matters arising out of or in connection with this Terms of Use, are subject to and interpreted by the laws of Malaysia.

19. SEVERABILITY

If one or more of the provisions in this Terms of Use becomes invalid, unenforceable, or violates the law either in whole or in part, based on the laws and regulations, this will not nullify the validity and enforceability of other provisions in this Terms of Use. Accordingly, other provisions of this Terms of Use will remain in full force and effect, regardless of the provisions which are deemed invalid, unenforceable or in violation of the law.
